📜 Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and the operators of Enclave Bazaar ("we", "us", "our", the "Platform"). By browsing ads, creating an account, posting a listing, contacting an advertiser, placing an order, or otherwise using any part of the service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy read, understood, and agree to them. If you do not agree, do not use the Platform.

1. What the Platform is — and is not

• We only advertise. Enclave Bazaar is a neutral community venue that lets residents publish ads — items, property, services, domestic help, cars, and food — and lets other neighbours discover and contact them.
• We are not a dealer, broker, agency, employer, restaurant, or courier, and we do not negotiate or participate in any deal.
• We do not own, inspect, endorse, or guarantee any item, listing, price, service, food, or user. Ads are community-submitted; we do not verify ownership, quality, or the truth of any statement in a listing.
• Phone verification is not an endorsement. We verify an advertiser's mobile number by one-time code only to reduce anonymous abuse — it does not verify their identity, honesty, or the accuracy of the listing.

2. No liability for dealings between users

• Any transaction, negotiation, payment, advance/token, service, order, agreement, or dispute is solely between the buyer and the seller/provider. We are not a party to it and bear no legal or financial liability of any kind arising from it.
• To the fullest extent permitted by law, we are not liable for any fraud, scam, misrepresentation, defective or unsafe goods or food, non-delivery, poor workmanship, theft, loss of money, or any other wrongful act by any user or third party.
• We do not guarantee that any listing is genuine, that any advertiser is who they claim to be, or that any item, service, or food exists, is available, is lawful, or is fit for purpose.

3. Your duty to verify — both sides

Because we do not vet ads, you must carry out your own due diligence before parting with any money, documents, or possession:

• Meet in a public place inside Islamabad & Rawalpindi, inspect and test the item before you pay, and never pay in advance for goods you have not seen.
• For property, independently verify ownership, original documents, dues clearance, and society approvals before any token or payment.
• For domestic help and services, always confirm CNIC and police/background verification and agree terms in advance.
• Never share your OTP, PIN, or password. No one legitimate — including us — will ever ask for them. Treat any such request as a scam.

You accept full responsibility for the consequences of proceeding without proper verification.

4. Consent required to post an ad

When you submit an ad you must actively accept these Terms. By submitting, you represent, warrant, and consent that:

• You lawfully own the item/property or are duly authorised to advertise it, or are genuinely able to provide the advertised service or food.
• All information, photos, and prices you provide are true, accurate, current, and not misleading, and the item or service is genuinely available on the stated terms.
• You consent to your submission being recorded together with technical metadata — including your IP address, browser/device information, and timestamps — for security, moderation, fraud-prevention, and legal record-keeping, as described in our Privacy Policy.
• You authorise us to display, adapt, and distribute your ad on the Platform and in related community channels, and to moderate or remove it at our discretion.

5. Prohibited conduct

You must not: post false, fraudulent, duplicate, or misleading ads; advertise items you do not own or are not authorised to sell; impersonate anyone; harvest other users' data; post unlawful, obscene, counterfeit, defamatory, or infringing content; sell prohibited or illegal items; use the Platform to defraud, harass, or spam; or use bots/scrapers. We may remove any ad and suspend or restrict any account at our sole discretion, without notice, and may report unlawful activity to the authorities.

6. Objectionable content — zero tolerance, reporting & blocking

Enclave Bazaar has zero tolerance for objectionable content and for abusive users. By creating an account, posting a listing or review, placing an order, contacting another user, or otherwise using the Platform, you accept this policy as part of these Terms.

• Objectionable content is prohibited. You must never post, send, or share content that is unlawful, obscene, pornographic or sexually explicit, hateful, harassing, bullying, threatening, violent, discriminatory, defamatory, deceptive or fraudulent, spam, or that promotes illegal goods, services, or activity, or that otherwise violates these Terms or the rights, privacy, or safety of others.
• We moderate. We filter and review listings, reviews, and other user-generated content, and we may remove any content and suspend, restrict, or permanently ban any account at our sole discretion and without notice.
• Report objectionable content. Every listing and message includes a Report / Flag option so you can alert us to content that breaks this policy; you can also email us at anjum.farrukh@gmail.com. Reports are treated confidentially.
• Block abusive users. You can block any user from the app; a blocked user can no longer contact you, and their content is hidden from you immediately.
• Our 24-hour commitment. We act on reports of objectionable content or abusive behaviour within 24 hours — removing the offending content and ejecting the user responsible by suspending or permanently banning their account. Repeat or serious offenders are permanently removed, and unlawful activity is reported to the authorities.

7. Records, authorities & your right to deletion

For the protection of the community we record submission metadata (see the Privacy Policy), including the IP address and browser/device details from which an ad or inquiry is submitted. We may retain and disclose this information to law-enforcement or other lawful authorities in response to a valid request, or where we reasonably believe it necessary to investigate fraud or protect users, consistent with the Prevention of Electronic Crimes Act, 2016 (PECA) and applicable law.

You may request deletion of your account and data at any time — through the account & data deletion request page (no login required, reachable without the app), the in-app Account option, or by emailing us. We action deletion requests manually and, in line with our soft-delete practice, retain only the limited records we are legally required or permitted to keep, as set out in the Privacy Policy.

8. Disclaimers & limitation of liability

The Platform and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, availability, fitness for a particular purpose, or non-infringement. Nothing on the Platform constitutes legal, financial, medical, or professional advice.

To the maximum extent permitted by law, we, our operators, owners, volunteers, and service providers shall not be liable for any direct, indirect, incidental, special, or consequential damages, or for any loss of money, property, data, or goodwill, arising out of or relating to your use of the Platform, any listing, any transaction between users, or any wrongful act by any user or third party. You agree to indemnify and hold us harmless from any claim arising from your use of the Platform, your content, your dealings with other users, or your breach of these Terms.

These Terms are governed by the laws of the Islamic Republic of Pakistan, and you agree to the exclusive jurisdiction of the courts at Islamabad. If any provision is held unenforceable, the remaining provisions continue in full force. We may update these Terms at any time; material changes take effect when posted here with a new "last updated" date, and your continued use means you accept them.
